Terms of use

1. Who we are

Macrobell is a nutrition, workout and step tracker provided by Proffitt Investment Holdings LLC, a California limited liability company, 1251 Montalvo Way, Unit G, Palm Springs, CA 92262 (“we”, “us”). By using the app or this website you agree to these terms. If you don’t agree, please don’t use Macrobell. You must be at least 13 years old to use Macrobell, and if you are under 18 you need a parent or guardian’s permission.

2. Not medical advice

Macrobell gives estimates for general fitness and education. Calorie goals, calories burned, AI photo estimates, form scores, body fat estimates, projections and exercise demos are approximations and can be wrong. Macrobell is not a medical device and does not diagnose, treat or prevent any condition. Talk to a doctor before starting a diet or exercise program, especially if you are pregnant, have a health condition or have a history of disordered eating. Stop exercising and get help if you feel pain, dizziness or shortness of breath.

3. Exercise safety

Exercise carries a risk of injury. Demos and instructions show general technique and can’t account for your body, your equipment or your surroundings. You are responsible for exercising safely and within your limits.

4. Your account

You sign in with an email address and password. Keep your password private; you are responsible for what happens in your account. You can delete your account at any time in the app under More › Account › Delete my account, which permanently deletes your account and the data saved in it from our servers. See the privacy policy for how your data is handled.

5. Squads

If you join a squad, other members see the display name you choose and your weekly percentages. Don’t use a display name you don’t want them to see, and don’t use a name or squad name that is offensive, impersonates someone or breaks the law. Squad owners can remove members, and you can report a member who misuses a squad. We may remove squads or accounts that break these rules.

6. Macrobell Plus

Macrobell Plus is an optional subscription costing $2.99 per month or $19.99 per year in the US (or the local price shown in the store), with a 7-day free trial for new subscribers. We may offer an introductory price, such as $1 for the first month; the store shows the exact offer before you confirm. Payment is charged to your Google Play or App Store account when you confirm, or when the trial ends. The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in your Google Play or App Store subscription settings; deleting the app does not cancel it. If we change the price, the store will tell you before it applies to you. Refunds are handled by Google or Apple under their policies.

7. AI features

AI features are part of Plus. When you use one, the photo, video frames or text you choose are sent to an AI provider so it can answer. AI features have a daily usage limit (10 requests a day today), which we may change with notice. AI answers are estimates and can be wrong; check them before relying on them. Macrobell also looks up foods through Open Food Facts and USDA FoodData Central. We don’t control these services and aren’t responsible for their accuracy or availability.

8. Acceptable use

Don’t use Macrobell to break the law, to harass anyone, to interfere with the app or the services it connects to, to get around usage limits, or to copy, resell or reverse engineer the app except where the law allows it.

9. Content and licenses

Food data comes from Open Food Facts (Open Database License) and USDA FoodData Central. Exercise photos and instructions come from the Free Exercise DB (public domain). The Macrobell name, logo, design, illustrations and animations belong to us. We give you a personal, non-transferable license to use the app for your own fitness tracking.

10. Disclaimers and limits

Macrobell is provided “as is”, without warranties of any kind, to the fullest extent the law allows. We don’t promise that it will be accurate, uninterrupted or error-free. To the fullest extent the law allows, we are not liable for any indirect or consequential loss, or for any injury, loss or damage arising from your use of the app or reliance on its estimates, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that can’t be limited.

11. Ending

You can stop using Macrobell and delete your account at any time. We may suspend or end accounts that break these terms. We may change or stop the app; if we stop it, we will give you reasonable notice where we can.

12. Law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes will be heard in the state or federal courts in Riverside County, California, unless the law where you live gives you the right to bring a claim there.

13. Changes

We may update the app and these terms. The current version is always on this page with the date it last changed. Continuing to use Macrobell after a change means you accept the new terms.

14. App Store

If you got Macrobell from Apple’s App Store, these terms are between you and us, not Apple. Apple is not responsible for the app or its support, and Apple’s standard end user license agreement also applies. Apple and its subsidiaries are third-party beneficiaries of these terms.
